Terms and Conditions for Havdryss

In the event of any discrepancy, the Norwegian version of these terms shall prevail.

Introduction

These terms and conditions apply to consumer purchases of goods from Havdryss made via the internet. Such purchases are primarily governed by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act and the E-commerce Act. These laws grant consumers mandatory rights that cannot be waived. The laws are available at www.lovdata.no.

These terms are not intended tolimit any statutory consumer rights, but to clarify the parties’ principal rights and obligations in connection with the purchase.

These terms are based on the standard terms recommended by the Norwegian Consumer Authority (Forbrukertilsynet).

 

1. The Agreement

The agreement consists of these terms and conditions, information provided in the ordering solution, and any separately agreed terms. In the event of a conflict, specifically agreed terms shall prevail, provided they do not conflict with mandatory legislation.

The agreement is supplemented by relevant statutory provisions governing consumer purchases.

 
2. The Parties

Hereinafter referred to as the Seller.

Buyer:
The consumer placing the order, hereinafter referred to as the Buyer.

 
3. Price

The stated price for the goods is the total price to be paid by the Buyer. The price includes value added tax and all applicable charges. Any shipping costs are disclosed before the purchase is completed.

The Buyer shall not be charged any costs that were not disclosed prior to the purchase.

 
4. Conclusion of the Agreement

The agreement is binding for both parties when the Buyer has submitted the order to the Seller. An order confirmation is normally sent by e-mail.

The agreement is not binding if there are obvious typographical or pricing errors in the offer that the Buyer understood or should have understood to be an error.

5. Payment

Payment can be made via Vipps, PayPal and Stripe. The amount is charged when the order is completed.

 
6. Delivery

Delivery has taken place when the Buyer, or the Buyer’s representative, has taken possession of the goods.

Unless a specific delivery time is stated, the goods shall be delivered without undue delay and no later than 30 days after the order is placed. Normal delivery time is 2–5 business days.

7. Risk of Loss or Damage

The risk for the goods passes to the Buyer when the goods have been delivered in accordance with section 6.

 
8. Right of Withdrawal

The Buyer has a 14-day right of withdrawal in accordance with the Norwegian Right of Withdrawal Act. The withdrawal period begins on the day after the goods are received.

The Buyer must notify the Seller of the use of the right of withdrawal within the withdrawal period. Notification should be made in writing to post@havdryss.no.

If the right of withdrawal is exercised, the goods must be returned within 14 days. The Buyer bears the direct costs of returning the goods.

The Seller shall refund the purchase price within 14 days after receiving notice of withdrawal, but may withhold the refund until the goods have been received or documentation of return has been provided.

Exception to the right of withdrawal:
The right of withdrawal does not apply to sealed food products where the seal has been broken after delivery, cf. section 22 (g) of the Norwegian Right of Withdrawal Act. This applies to Havdryss products for reasons of food safety and hygiene.

 
9. Delay and Non-Delivery

If the Seller fails to deliver the goods or delivers them late, and this is not due to the Buyer or circumstances on the Buyer’s side, the Buyer may, in accordance with the Consumer Purchases Act, withhold payment, demand performance, terminate the agreement and/or claim compensation.

 
10. Defects and Complaints

If the goods are defective, the Buyer must notify the Seller within a reasonable time after the defect was discovered or should have been discovered. A complaint may be made no later than two years after delivery.

Complaints shall be submitted to post@havdryss.no.

In the event of a defect, the Buyer may claim repair, replacement, a price reduction, termination of the agreement or compensation in accordance with the Consumer Purchases Act.

 
11. Seller’s Rights in the Event of Buyer’s Breach

If the Buyer fails to pay or otherwise breaches the agreement, the Seller may, in accordance with applicable law, demand payment, terminate the agreement and claim compensation. Interest on late payment may be charged pursuant to the Norwegian Late Payment Interest Act.

 
12. Warranty

Any warranty provided by the Seller or manufacturer is in addition to the Buyer’s statutory rights and does not limit the Buyer’s right to make claims due to delay or defects.

 
13. Personal Data

The Seller is the data controller for personal data collected in connection with the purchase. Personal data is processed in accordance with applicable data protection legislation and is used only to fulfil the agreement or where required by law.

 
14. Dispute Resolution

Complaints should be addressed to the Seller within a reasonable time. The parties shall attempt to resolve any disputes amicably.

If no amicable solution is reached, the Buyer may contact the Norwegian Consumer Council (Forbrukerrådet) for mediation.
